Anti-Corruption Compliance Mechanisms in the Hotel and Restaurant Sector: International Practice and Ukrainian Context

Abstract

The purpose of the article is predetermined by the need to increase transparency and ethical management in the HoReCa sector, which remains vulnerable to corruption due to a large number of permitting procedures, significant cash flows and shadow schemes. The study focuses on anti-corruption compliance as an internal control tool that allows systematic prevention of violations and promotes the formation of an integrity environment in the hotel and restaurant business. Particular attention is paid to international practices of implementing such programs, in particular, the experience of implementing the ISO 37001 standard in hotel chains, the effect of the FCPA and the UK Bribery Act in the hospitality sector. The study provides a comparative analysis of the application of anti-corruption compliance in foreign companies and Ukrainian HoReCa entities. The methods of legal analysis, expert survey, content analysis and interpretation of regulatory documents were used. It is established that in Ukraine, compliance is mostly perceived as a formality rather than a management tool. The author substantiates the need to adapt international standards to national conditions, taking into account the scale of enterprises and available resources. Proposals for the development of standard internal policies, training programs for staff and indicators for assessing the effectiveness of compliance systems are developed. The results of the study showed a low level of institutionalization of compliance approaches in most Ukrainian hospitality companies, a lack of unified ethical standards, and limited awareness of the benefits of such mechanisms among management personnel. At the same time, the analysis of international experience has shown that the implementation of anti-corruption compliance has a positive impact on the reputation channel, consumer confidence and access to investment. The author proposes areas for further research, in particular, the development of models for integrating compliance policies into the service quality management system, as well as the creation of industry recommendations for the hotel and restaurant sector, taking into account Ukrainian legislation and international standards.
